Ancak, y\u00fcklenicinin y\u00fck\u00fcml\u00fcl\u00fcklerini yerine getirmemesi sebebiyle s\u00f6zle\u015fme, \u015firketimiz taraf\u0131ndan 13.09.2022 tarihinde feshedilmi\u015f ve bu fesih i\u015flemini takiben adi ortakl\u0131k ve ortaklar\u0131yla aram\u0131zda hukuki s\u00fcre\u00e7ler ba\u015flam\u0131\u015f ve g\u00fcn\u00fcm\u00fcze dek devam etmi\u015ftir.<\/p>\n<p>Gelinen a\u015famada, \u0130lk ve Kaf i\u015f ortakl\u0131\u011f\u0131n\u0131n 14.11.2025 tarihli ba\u015fvurusuyla \u015firketimize m\u00fcraacat ederek, \u015firketimizle mevcut hukuki uyu\u015fmazl\u0131klar\u0131n sulhen \u00e7\u00f6z\u00fclmesini ve \u0130zmir Konak Karma (VYenikonak) Projesi&#039;ni tamamlamaya talip olduklar\u0131n\u0131 bildirmi\u015ftir. \u015eirketimiz, 17.11.2025 tarihli y\u00f6netim kurulu toplant\u0131s\u0131nda uzla\u015fma talebine istinaden, \u0130lk-Kaf i\u015f ortakl\u0131\u011f\u0131 ve ortaklar\u0131yla \u015firketimizin kar\u015f\u0131l\u0131kl\u0131 taraf oldu\u011fu t\u00fcm davalara ili\u015fkin olarak, adi ortakl\u0131\u011f\u0131n herhangi bir vekalet \u00fccreti, yarg\u0131lama gideri, sair hak\/menfaat talebi olmaks\u0131z\u0131n t\u00fcm davalardan feragat etmesi, adi ortakl\u0131k taraf\u0131ndan projenin mevcut durumundan anahtar teslimine dek yar\u0131m kalan t\u00fcm in\u015fai i\u015flerin tamamlanmas\u0131, 30.06.2025 tarihli de\u011ferleme raporunda belirtilen 11.637.839.000 TL + KDV tutar\u0131ndaki asgari has\u0131lat bedeli esas al\u0131narak gelir payla\u015f\u0131m oran\u0131n\u0131n y\u00fczde 30&#039;dan Vak\u0131f GYO lehine y\u00fczde 38&#039;e \u00e7\u0131kar\u0131lmas\u0131, has\u0131lat ve s\u00f6zle\u015fme garantisine ili\u015fkin olarak \u015firketimiz pay\u0131na d\u00fc\u015fen 4.422.378.820 TL + KDV toplam tutar\u0131 kadar kesin ve s\u00fcresiz teminat mektuplar\u0131 al\u0131nmas\u0131 ko\u015fullar\u0131yla uzla\u015fma talebinin kabul\u00fc do\u011frultusunda sulh ve ibra protokol\u00fcn\u00fcn imzalanmas\u0131, yukar\u0131daki \u015fartlarla ihtiya\u00e7 duyulan di\u011fer h\u00fck\u00fcmlerin de d\u00fczenlenerek s\u00f6zle\u015fme tadilinin imzalanmas\u0131, y\u00fcr\u00fcrl\u00fck s\u00fcresi boyunca s\u00f6zle\u015fme h\u00fck\u00fcmlerinin tatbik edilmesi hususlar\u0131nda genel m\u00fcd\u00fcrl\u00fck makam\u0131n\u0131n yetkilendirilmesine karar verilmi\u015ftir. Sulh ve ibra protokol\u00fc, ilgili taraflarla ayn\u0131 g\u00fcn imzalanm\u0131\u015ft\u0131r.
