Eski\u015fehir ili, Tepeba\u015f\u0131 il\u00e7esi s\u0131n\u0131rlar\u0131nda yer alan Sepet\u00e7i ve Marg\u0131 mahallelerindeki tar\u0131m arazilerinin; Alpu Termik Santrali, ek tesisleri ve k\u00fcl depolama sahas\u0131 olarak kullan\u0131lmas\u0131na y\u00f6nelik verilen “tar\u0131m d\u0131\u015f\u0131 kullan\u0131m” izinlerine kar\u015f\u0131 a\u00e7\u0131lan davada karar verildi. Mahkeme, b\u00f6lgenin tar\u0131msal b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fcn korunmas\u0131na h\u00fckmetti.<\/p>\n
Daha \u00f6nce Eski\u015fehir 2. \u0130dare Mahkemesi taraf\u0131ndan reddedilen ve ard\u0131ndan istinaf ba\u015fvurusu da olumsuz sonu\u00e7lanan dava, belediyenin \u0131srarl\u0131 takibi sonucu Dan\u0131\u015ftay’a ta\u015f\u0131nm\u0131\u015ft\u0131. Dan\u0131\u015ftay Onuncu Dairesi’nin 25 Eyl\u00fcl 2025 tarihli bozma karar\u0131, s\u00fcrecin seyrini de\u011fi\u015ftirdi. Bursa B\u00f6lge \u0130dare Mahkemesi Alt\u0131nc\u0131 \u0130dari Dava Dairesi, Dan\u0131\u015ftay\u2019\u0131n bu karar\u0131na uyarak dosyay\u0131 yeniden inceledi ve ilk derece mahkemesinin ret karar\u0131n\u0131 kald\u0131rarak s\u00f6z konusu idari i\u015flemlerin iptaline oybirli\u011fiyle karar verdi.<\/p>\n
Mahkeme karar\u0131nda, projenin en temel dayanaklar\u0131ndan biri olan “\u00c7ED Olumlu” karar\u0131n\u0131n daha \u00f6nce yarg\u0131 yoluyla iptal edildi\u011fi ve bu iptalin kesinle\u015fti\u011fi hat\u0131rlat\u0131ld\u0131. \u00c7evre Kanunu ve ilgili y\u00f6netmelikler uyar\u0131nca; hukuken ge\u00e7erli bir \u00c7ED karar\u0131 bulunmayan bir projenin hayata ge\u00e7irilemeyece\u011fi, dolay\u0131s\u0131yla bu projeye istinaden verilen tar\u0131m d\u0131\u015f\u0131 kullan\u0131m izinlerinin de uygulama kabiliyetinin kalmad\u0131\u011f\u0131 vurguland\u0131.<\/p>\n
